Commissioned Artwork
Although it looks like standard, boring small print,
please read the following carefully as it is for the protection of the
artist, ourselves and most importantly, you, the Client. If you have any

1. Artunframed shall not be required to reproduce any matter which in their
opinion is or may be libelous, likely to infringe a third party’s
intellectual property rights or otherwise be of an illegal nature.
Copyright licence
2. The copyright of the work commissioned by the client shall be retained by
Artunframed.
Price and payment
3. The client agrees to pay the commission fees in accordance with the
written proposal from Artunframed.
4. The client shall pay all invoices within 30 days of their receipt.
Cancellation/rejection
5. If the work is cancelled or rejected by the client within 30 days of
receipt, the client will receive a full refund of any payment made.
Delivery
6. Artunframed will use all reasonable endeavors to deliver the work to the
client by the agreed date but will not be liable for delays caused by
matters outside their control. Any times or dates quoted for the supply of
the work are an estimation only.
7. Artunframed shall not be liable for any consequential loss or damages
arising from late delivery of, or any defect in, the work and their
liability for all claims, loss or damage arising under this agreement
whatsoever and through negligence or breach of contract or howsoever shall
be limited to the value of the fees paid under this agreement.
Warranties
8. Except where the work is based on reference material or visuals supplied
by the client or where otherwise agreed, Artunframed warrant that, as far as
they are aware, the work is original and does not knowingly infringe any
existing copyright.
9. Any claim by the client which is based on any defect in the work or its
failure to correspond with the proposal shall be notified in writing to
Artunframed within 30 days from the date of delivery. If the client does not
notify Artunframed accordingly, the client shall not be entitled to reject
the work and Artunframed shall have no liability for such defect or failure,
and the client shall be bound to pay the price as if the work had been
delivered in accordance with the agreement.
10. Where any valid claim in respect of any of the work which is based on
any defect in the quality or condition of the work or its failure to comply
with the proposal is notified to Artunframed in accordance with these
conditions, Artunframed will refund to the client the price of the work (or
a proportionate part of the price if agreed by the client), but Artunframed
shall have no further liability to the client.
11.
To receive a refund, the client must return the product to Artunframed's
designated address within thirty (30) days after delivery and otherwise
follow the return procedure as explained in the shipment documentation. The
product must be returned in the original tube and packing material, in good
condition. The client is responsible for the product until it is
received by Artunframed. The client is responsible for arranging the
safe return of the product and for all shipping, handling and insurance
charges, unless otherwise agreed by Artunframed.
Ownership of the work
12. The client shall retain ownership of the work delivered to the client.
Copyright will be retained in full by Artunframed.
General
13. The client shall purchase the commissioned work, painting, drawing or
illustration in accordance with any emailed proposal from Artunframed which
is accepted by the client, or any order of the client which is accepted by
Artunframed in writing, subject in either case to these conditions, which
shall govern the contract to the exclusion of any other terms and conditions
and no variation to these conditions shall be binding unless agreed in
writing between the parties.
